Illinois Child Support

Support is all about your kids. Just like you, it is our goal to make sure they are taken care off. The Illinois legislature has provide rules and guidelines to ensure that children do not suffer in a divorce and receive sufficient support. At The Law Office of J. Patrick Nelson, PC, we have extensive experience and expertise navigating the statutes to the ultimate benefit of our clients.
Illinois Child Support Guidelines
The Illinois child support statute was amended on July 1, 2017. The changes to child support were significant in that support is no longer based on a set percentage of the payor's net income but based on an income-sharing model. Child support is now calculated based on both parents' income and each parent is responsible for paying his or her prorated share of the child's support. The child support is calculated by determining each party's monthly net income from all sources and then divide each party's adjusted net income by the combined adjusted net income. Identify the basic child support obligation and then multiply the basic child support obligation by each parent's percentage of combined adjusted net income to determine each parent's contribution toward the basic child support obligation. The basic child support obligation can be found by finding the income shares table based on the combined adjusted net income at https://www.illinois.gov/hfs/SiteCollectionDocuments/IncomeSharesSchedulesBasedonNetIncome.pdf. The child support estimator can be found at https://cscwebext.hfs.illinois.gov/CscWebex/app/estimator?execution=e1s1
Section 5/505 of the Illinois Marriage and Dissolution of Marriage Act provides that the above guideline shall be applied in each case unless the court makes a finding that a deviation is warranted.
